# Terms of Service

## Overview

Welcome to Inner State. The terms “Inner State,” “we,” “us,” and “our” refer to the seller operating this online store. We provide this website, its content, features, products, and related services (collectively, the “Services”) to offer customers an online shopping experience. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products and Services to you.

These Terms of Service (“Terms”), together with the policies referenced below, explain your rights and responsibilities when you access or use the Services. By visiting the website, creating an account, or placing an order, you agree to these Terms and our [Privacy Policy](/policies/privacy-policy), [Refund Policy](/policies/refund-policy), and [Shipping Policy](/policies/shipping-policy), each of which is incorporated into these Terms by reference. If you do not agree, do not use the Services.

Nothing in these Terms limits any consumer right or remedy that cannot legally be limited or waived.

## Section 1 — Eligibility, access, and accounts

You must be at least the age of majority where you live to make a purchase, or you must use the Services with the involvement and permission of a parent or legal guardian.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for safeguarding your login credentials and for activity under your account. Please notify us promptly if you believe your account has been used without authorization. You may not sell, transfer, assign, or license your account to another person.

## Section 2 — Products and made-to-order production

Many Inner State products are made to order. After you place an order, a third-party production and fulfillment provider—which may include Printify and a print provider in its network—may print, embroider, package, and ship the product on our behalf.

We make reasonable efforts to display product colors, artwork, placement, materials, and other details accurately. Your screen settings and the production process can cause slight differences in color, texture, print placement, or appearance. Minor variations that are consistent with normal production standards are not considered defects, provided that the product is not materially different from its description. Your legal rights concerning defective or misdescribed goods remain unaffected.

Fit and measurements can vary between garments and manufacturers. Please review the size chart shown on the specific product page before ordering. Product descriptions, prices, designs, available colors, and availability may change without notice. We may discontinue a product or limit quantities by customer, household, geographic area, or order where reasonably necessary.

## Section 3 — Orders, acceptance, and cancellations

Placing an order is an offer to purchase. An automatic order confirmation acknowledges that we received your order; it does not prevent us from declining or canceling the order before fulfillment. We may decline or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or listing errors, unavailable products, shipping restrictions, or violation of these Terms. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

Please check the product, size, color, personalization, quantity, and delivery address before submitting your order. Made-to-order production can begin shortly after an order is received. You may request a change or cancellation by contacting us immediately, but we cannot guarantee that a request can be completed after production has begun. Approved refunds, returns, exchanges, and cancellations are governed by our [Refund Policy](/policies/refund-policy).

We may contact you using the email address, telephone number, billing address, or shipping address submitted with the order if we need to verify or update it.

## Section 4 — Prices, taxes, and payment

Prices are shown in the currency identified at checkout and may change before an order is placed. Unless stated otherwise, listed prices do not include shipping charges, taxes, duties, customs charges, or other fees that may apply. The final amount payable by you will be shown at checkout before you submit payment.

You authorize us and our payment processors to charge the payment method you provide for your order and any amounts disclosed at checkout. You represent that you are authorized to use that payment method and that the information supplied is accurate. Discounts and promotions may have additional terms; if those promotional terms conflict with these Terms, the promotional terms govern for that promotion.

If a product is listed at an incorrect price or with materially incorrect information, we may correct the error and, where appropriate, contact you for instructions or cancel and refund the affected order.

## Section 5 — Fulfillment, shipping, and delivery

Our products may be produced and shipped by third-party fulfillment providers. Production time and carrier transit time are separate. Any production, shipping, or delivery date shown on the website, at checkout, or in an order update is an estimate unless we expressly state otherwise.

When tracking is available, it will be sent to the contact information provided with the order. An order may arrive in more than one package or from more than one fulfillment location. You are responsible for providing a complete and accurate delivery address. If a package is returned because an address supplied by you was incomplete or incorrect, we may require payment of reasonable reshipping costs before sending it again, unless the error was ours.

If we learn that we cannot ship within the time promised, or within the time required by applicable law when no time was promised, we will provide any notice, delay option, cancellation option, or refund required by law. ## Section 6 — Returns, refunds, and product problems

Returns, exchanges, refunds, and replacements are governed by our [Refund Policy](/policies/refund-policy). Because many products are produced specifically after an order is placed, returns or exchanges for selecting the wrong size or color, or for a change of mind, may be unavailable where permitted by law.

If an item arrives damaged, has a manufacturing or printing defect, is materially different from what you ordered, or the wrong item was delivered, contact us within the period stated in our Refund Policy. Include your order number and clear photographs of the item and packaging when requested so that we can investigate and arrange an appropriate remedy.

This section does not exclude or restrict any return, refund, replacement, cancellation, warranty, or other right that applicable law requires us to provide.

## Section 7 — Intellectual property

The Services and their content—including artwork, text, graphics, photographs, videos, product designs, logos, page layouts, and software—are owned by or licensed to Inner State and are protected by applicable intellectual property laws. Inner State names, logos, designs, and slogans may not be used without our prior written permission. Shopify’s marks and all third-party marks belong to their respective owners.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, sell, license, publicly display, create derivative works from, or commercially exploit any part of the Services without the applicable owner’s prior written permission.

## Section 8 — Feedback, reviews, and user content

If you submit a review, photograph, comment, suggestion, or other content (“Feedback”), you represent that you own it or have permission to submit it, that it is accurate to the best of your knowledge, and that it does not violate law or another person’s rights. You must disclose any payment, free product, discount, or other incentive connected with your Feedback.

You grant Inner State a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, and distribute that Feedback for operating, improving, and promoting the Services, subject to our Privacy Policy and applicable law. You retain ownership of your Feedback. We may moderate or remove Feedback that we reasonably believe is unlawful, deceptive, abusive, infringing, unrelated, or otherwise violates these Terms.

## Section 9 — Optional tools, third-party services, and links

The Services may include tools, payment services, integrations, or links operated by third parties. Their own terms and privacy practices may apply. We do not control third-party websites and are not responsible for transactions that you independently enter into on them. Review the relevant third party’s policies before using its services.

Our use of a production, fulfillment, payment, or shipping provider does not change your relationship with Inner State as the seller. For help with an Inner State order, contact us using the information in Section 23 rather than contacting a print provider directly.

## Section 10 — Relationship with Shopify

Inner State is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Inner State. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Inner State, including any injury, damage, or loss resulting from purchased products and services. To the extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Inner State.

## Section 11 — Privacy

Our collection and use of personal information are described in our [Privacy Policy](/policies/privacy-policy). Because Shopify hosts the Services, Shopify also processes certain personal information needed to provide and improve its platform. You can review [Shopify’s Consumer Privacy Policy](https://privacy.shopify.com/en).

Information may also be shared with payment processors, production and fulfillment providers, carriers, analytics providers, and other service providers as described in our Privacy Policy, including providers located outside your state, province, or country.

## Section 12 — Errors and changes to the Services

The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, shipping charges, transit estimates, or availability. We may correct or update that information and take reasonable steps concerning an affected order, including contacting you or canceling and refunding the order when appropriate.

We may modify, suspend, or discontinue any non-purchased feature or portion of the Services at any time. Changes will not reduce rights that already apply to a completed purchase.

## Section 13 — Prohibited uses

You may use the Services only for lawful purposes. You may not:

- violate any law or another person’s rights;
- infringe intellectual property, privacy, publicity, or other rights;
- submit false, misleading, fraudulent, abusive, defamatory, obscene, or harmful material;
- impersonate another person or misrepresent your identity or affiliation;
- introduce malware or interfere with the security, availability, or operation of the Services;
- collect personal information about others without authorization;
- send spam or other unauthorized advertising;
- bypass access controls, rate limits, robot exclusions, or security measures; or
- scrape, copy, extract, or commercially exploit the Services through manual or automated means without our written permission.

We may suspend or terminate access when we reasonably believe these Terms have been violated.

## Section 14 — Termination

You may stop using the Services at any time. We may suspend or terminate your access for a material violation of these Terms, fraud, abuse, security risk, or where necessary to comply with law. Termination does not cancel payment obligations or other responsibilities that arose before termination.

Provisions that by their nature should survive termination—including intellectual property, Feedback licenses, disclaimers, limitations of liability, indemnification, governing law, and payment obligations—will continue to apply.

## Section 15 — Disclaimer of warranties

Except for warranties expressly stated by Inner State or required by law, the website and Services are provided on an “as is” and “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we disclaim implied warranties relating to the Services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some or all of these exclusions may not apply to you. Product remedies expressly offered in our Refund Policy and all non-waivable statutory warranties remain available.

## Section 16 — Limitation of liability

To the fullest extent permitted by law, Inner State and its owners, affiliates, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, savings, goodwill, or data, arising from the Services or a product purchased through them, even if advised that such damages were possible.

To the fullest extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim. These limitations do not apply where prohibited by law, including to liability that cannot legally be excluded or limited for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence.

## Section 17 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Inner State, Shopify, and our respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal fees arising from your unlawful misuse of the Services, your material breach of these Terms, or your violation of another person’s rights.

We will provide reasonable notice of an indemnified claim and may control its defense and settlement, provided that we will not agree to a settlement that imposes a non-monetary obligation on you without your consent. You agree to reasonably cooperate with the defense.

## Section 18 — Severability

If any part of these Terms is held unlawful, void, or unenforceable, that part will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will continue in effect.

## Section 19 — Waiver and entire agreement

Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms and the policies incorporated into them constitute the entire agreement between you and Inner State regarding the Services and replace prior agreements or communications on the same subject.

## Section 20 — Assignment

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or other lawful business transfer, subject to applicable law.

## Section 21 — Governing law and venue

Changes apply prospectively and do not reduce rights attached to orders placed before the change took effect.
